1. Purpose<\/p>\n
These General Terms and Conditions define the rights and obligations of the parties in the context of the remote booking of services offered by MAISON AILLEURS, located in Chartres, via its Website and Mobile Services.<\/p>\n
They govern all the steps necessary for booking and monitoring the reservation between the contracting parties.<\/p>\n
Any reservation therefore implies the customer\u2019s full and unconditional acceptance of these General Terms and Conditions.<\/p>\n
Any customer acknowledges having the legal capacity to contract, namely being of legal age and not being under guardianship or curatorship.<\/p>\n
The terms \u201cEstablishment\u201d and \u201cSite\u201d used throughout this document refer to the website named https:\/\/maisonailleurs.com<\/p>\n
and corresponding to the domain accessible at https:\/\/maisonailleurs.com\/<\/p>\n

2. Scope of Application<\/p>\n
These General Terms and Conditions of Sale apply to all reservations made online, via the Website, Mobile Services, or partner platforms.<\/p>\n
3. Enforceability of the General Terms and Conditions<\/p>\n
In all cases, the version of the General Terms and Conditions enforceable against the customer is the one in force at the time the reservation is made on the Website, Mobile Services, or via partner platforms.<\/p>\n
4. Reservation<\/p>\n
Reservations may be made via the website, by telephone, or by email.<\/p>\n
A reservation becomes effective only once it has been guaranteed by the customer by providing a valid credit card number with expiration date, and after receipt of a detailed reservation confirmation.<\/p>\n
Payment for all services is made directly to the establishment (except in the case of prepaid reservations at the time of booking).<\/p>\n
The establishment reserves the right to refuse any reservation if the credit card number is invalid or if the reservation is incomplete.<\/p>\n
All reservations, regardless of origin, must be paid in euros only. The establishment accepts the following credit cards: Visa, Mastercard, and American Express, and uses a secure reservation system (SSL) that protects and encrypts all sensitive data transmitted during the booking process to prevent disclosure to third parties.<\/p>\n
At the time of reservation, a credit card authorization will be requested. This authorization is for verification purposes only and does not constitute a charge, except in the following cases:<\/p>\n
\u2013 \u201cNon-cancellable \/ non-refundable\u201d promotional offers<\/p>\n
\u2013 If the credit card expiration date precedes the arrival date<\/p>\n
The customer is solely responsible for their choice of services and their suitability for their needs. Consequently, the establishment cannot be held liable in this regard.<\/p>\n
5. Payment<\/p>\n
A charge of 50% of the total price is automatically debited at the time of booking, with the balance is due 2 days before arrival at the establishment, except in the case of special rates or according to the conditions of booking platforms.<\/p>\n
Two methods are available for the payment of the deposit:<\/p>\n
\u2013 Credit card<\/p>\n
\u2013 Bank transfer<\/p>\n
The reservation becomes firm and final only upon receipt of the deposit by the establishment within the specified timeframe.<\/p>\n
6. Right of Withdrawal<\/p>\n
In accordance with Article L.121-21-8 (12\u00b0) of the French Consumer Code, the customer is reminded that they do not benefit from the right of withdrawal provided for in Article L.121-21 of the Consumer Code.<\/p>\n
The sales conditions applicable to the reserved rate specify the terms and conditions for cancellation and\/or modification of the reservation.<\/p>\n
7. Modification of Stay<\/p>\n
Any modification request must be submitted to the establishment by email or telephone. The modification becomes effective only once the establishment has confirmed its acceptance in writing.<\/p>\n
In the event of a modification of stay, the following conditions apply (except in cases of force majeure):<\/p>\n
\u2013 In the event of no-show on the scheduled arrival date, the total amount of the stay will be charged to the credit card.<\/p>\n
\u2013 Any stay that has begun is due in full.<\/p>\n
8. Cancellation of Stay<\/p>\n
Any cancellation request must be submitted to the establishment by email or telephone. The cancellation becomes effective only once the establishment has confirmed its acceptance in writing.<\/p>\n
In the event of cancellation, the following conditions apply (except in cases of force majeure):<\/p>\n
\u2013 For any request made less than 48 hours before the arrival date, 100% of the total stay will be charged.<\/p>\n
\u2013 In the event of no-show on the scheduled arrival date, the total amount of the stay will be charged.<\/p>\n
\u2013 Any stay that has begun is due in full.<\/p>\n
9. Force Majeure<\/p>\n
Force majeure refers to any event beyond the control of the parties, which is unforeseeable, unavoidable, and external, preventing either the customer or the establishment from fulfilling all or part of their contractual obligations.<\/p>\n
Events considered as force majeure or fortuitous events are those generally recognized by French court jurisprudence.<\/p>\n
Neither party may be held liable to the other for failure to perform its obligations resulting from a force majeure event.<\/p>\n
It is expressly agreed that force majeure suspends the execution of the reciprocal obligations of the parties, each party bearing the costs resulting therefrom.<\/p>\n
10. Prices<\/p>\n
Prices are indicated in euros.<\/p>\n
Prices include only the services strictly mentioned in the reservation.<\/p>\n
Additional services provided by the establishment during the stay and, where applicable, tourist tax will be added to the price stated in the reservation at the time of billing.<\/p>\n
Applicable prices are those in force on the day of reservation. As an independent professional, the establishment is free to modify its prices at any time. Only the price indicated in the reservation confirmation is contractually binding.<\/p>\n
11. Complaints and Disputes<\/p>\n
Any complaint must be submitted to the establishment within 7 days following the stay.<\/p>\n
Failing recourse to conventional mediation or any alternative dispute resolution within 30 days, either party may refer the matter to the competent judicial court.<\/p>\n
12. Liability<\/p>\n
The establishment is responsible for obtaining all necessary guarantees and insurance required to welcome the public and operate its activity. The establishment\u2019s liability in the event of theft is limited to items entrusted to its care only. Guests are responsible for safeguarding their own belongings and equipment.<\/p>\n
The customer must inform the establishment of any damage they cause and is liable for all damages resulting from their actions. In the event of damage to the premises made available (room, common areas, lounge, sanitary facilities), the customer agrees to bear the costs of restoration.<\/p>\n
Any behavior contrary to public order or good morals will result in the establishment requesting the customer to leave the premises without compensation or refund if payment has already been made. If no payment has yet been made, the customer must pay the full price of the stay before leaving.<\/p>\n
The customer agrees not to invite any additional persons without prior approval from the establishment. The customer undertakes to ensure that all participants and guests comply with the establishment\u2019s rules and regulations (including the no-smoking policy) and that they do not disturb the operation or compromise the safety of the establishment or its occupants.<\/p>\n
Unless expressly stated otherwise, the customer must vacate the room by 10:30 a.m. on the day of departure. Failure to do so will result in an additional night being charged.<\/p>\n
Pets are not permitted at Maison Ailleurs Chartres. The establishment provides free Wi-Fi access. The customer agrees not to use the provided IT resources for illegal reproduction, representation, distribution, or public communication of copyrighted works without authorization, in accordance with French intellectual property law. Failure to comply may constitute an offense of infringement punishable by a fine of up to \u20ac300,000 and three years\u2019 imprisonment.<\/p>\n
The customer must also comply with the security policies of the establishment\u2019s internet service provider and refrain from any action that could compromise the effectiveness of these measures.<\/p>\n
Photographs displayed on the Website and Mobile Services of the establishment or its partners are for illustrative purposes only. Variations may occur, particularly due to changes in furnishings or renovations.<\/p>\n
The establishment cannot be held liable for non-performance or improper performance of the reservation due to force majeure, third-party actions, customer fault, internet network unavailability, website access issues, external intrusion, computer viruses, or unauthorized bank refusal of prepayment.<\/p>\n
13. Security Deposit and Liability for Damage<\/p>\n
A \u20ac300 security deposit is required for each stay. Its purpose is to cover any damage, deterioration, loss, breakage, or additional costs attributable to the Guest, accompanying persons, or any person for whom the Guest is responsible during the stay.<\/p>\n
The security deposit is secured by means of a pre-authorisation on the Guest\u2019s payment card. This pre-authorisation does not constitute a charge, and the amount will not be debited unless a justified deduction is made in accordance with these Terms and Conditions.<\/p>\n
If no damage, deterioration, loss, or additional costs attributable to the Guest are identified, the pre-authorisation will be released in full at the end of the stay.<\/p>\n
In the event of damage, deterioration, loss, or additional costs duly identified and attributable to the Guest, the Host may retain all or part of the security deposit, up to a maximum of \u20ac300, to cover the resulting loss.<\/p>\n
The security deposit constitutes a guarantee and does not limit the Guest\u2019s liability. If the amount of the loss or damage exceeds \u20ac300, the Host expressly reserves the right to request payment from the Guest of the additional amount corresponding to the actual loss suffered, upon presentation of the relevant supporting documents (quotations, repair invoices, replacement costs, or any other appropriate supporting evidence).<\/p>\n
The Guest remains liable for any damage, deterioration, or loss occurring during their stay, unless they can demonstrate that such damage, deterioration, or loss occurred through no fault of their own. This liability may also extend to damage or loss caused by persons accompanying the Guest or for whom the Guest is responsible.<\/p>\n
The Host will inform the Guest of any deduction made from the security deposit and, where possible, will provide the relevant documents supporting the amount deducted or claimed.<\/p>\n
14. Relocation<\/p>\n
In the event of exceptional circumstances or the inability to provide the reserved room, or in cases of force majeure, the establishment reserves the right to accommodate the customer, in whole or in part, in an establishment of equivalent category, offering services of the same nature, subject to the customer\u2019s prior agreement.<\/p>\n
Any additional room cost, transportation between establishments, and one telephone call shall be borne by the establishment.<\/p>\n
15. Mediation<\/p>\n
In accordance with French regulations on consumer dispute mediation (including Decree of 30 October 2015 and Ordinance No. 2015-1033 of 20 August 2015), professionals are required to offer a mediation procedure in the event of a dispute. The mediation outcome must occur within 90 days.<\/p>\n
Customers are invited to submit all requests by email to ensure dated correspondence and to keep personal records.<\/p>\n
Internal mediation<\/p>\n
For disputes not resolved amicably, customers may contact the Internal Mediation Service, which undertakes to provide a response within 30 days.<\/p>\n
External mediation<\/p>\n
If dissatisfaction persists, customers may refer the matter to an external mediator of their choice.<\/p>\n
Official information on mediation is available on the French government website and the European online dispute resolution platform.<\/p>\n
16. Applicable Law<\/p>\n
